Extended License & Copyright

When purchasing a PRO MEMBER membership at Her Creative Studio (HCS), you agree to and are granted a non-exclusive, non-transferable Extended License that allows for Commercial (Client use) use of the images created by HCS.

Sandra Manton Mills remains the original, sole, exclusive owner and holder of the copyright for all images.

Usage agreement

You May:

  • Use the images to promote yourself and your business.  A Standard License is automatically included with PRO Member membership.
  • Use the image(s) for up to 10 clients per year.  You may modify/create additional designs by adding text or graphics to the image(s) (modified, flattened and embedded) as part of a wider original project. Unlimited commercial use on social media and the web.
  • Use for up to 10 commercial (contracted and client) projects per year.
  • Unlimited copies of printed material (i.e. business cards)
  • To share your library access with Team Members to use on your company's behalf.  That includes employees on payroll but excludes VA's and anyone under contract.

Examples where the images can be used:

  • Web/digital uses: websites, web banners, newsletters, PDF documents, blogs, emails, slide shows, cell phones splash screens, social media images, hero images, shop banners, ad banners, graphic designs, in-house designs, templates, freebies, giveaways or free downloads, downloadable workbooks, guides or how-to's
  • Printed material: marketing, advertising, brochures, documents, booklets, business cards, brochures, posters, flyers, tearsheets for promotional purposes (not for resale), postcards
  • Examples of Commercial Projects:  Website themes, promotional videos, how-to videos

 

YOU MAY NOT

By Law you cannot use Her Creative Studio images for:

  • Use in any logo or trademark
  • Offensive, illegal or pornographic use.
  • Use in product packaging, magazine/book covers, ebooks, CDs/DVDs because permission has not been given by the companies of the products used in the photos.
  • Endorsing a product or service directly.
  • Products for resale (i.e. mugs, prints, totes, iphone cases, t-shirts etc.)

You may not re-license, redistribute, share or resell the images in part or whole.

Liability

Sandra Manton Mills (Her Creative Studio) is not liable against any claims, losses or costs associated with any damages that occur due to you using and editing the images included in your membership.

Members hereby agree to indemnify Sandra Manton Mills (Her Creative Studio) for all expenses that may be incurred should you breach any of the terms of the agreement.

Users acknowledge that Sandra Manton Mills (Her Creative Studio) does not claim any representations or assurances of non-infringement and does not make claim to have received releases from any brands, designers, or manufacturers for use of products, registered trademarks, logos or intellectual property portrayed in the images. Users agree that Sandra Manton Mills (Her Creative Studio)  shall not be liable for any damages resulting from the use of any of the images provided. Sandra Manton Mills (Her Creative Studio)  shall not be liable for any claims related to, or resulting from, your use of the images, which may or may not have been modified by you, or combined with other content.

Cancellation

Sandra Manton Mills (Her Creative Studio) has the right to terminate your membership at any time should you breach the terms and conditions agreed upon by you. No refund will be issued.

You may cancel your subscription at any time prior to a by-annual/annual charge but once payment has been processed, absolutely no refunds will be issued. Once cancelled, your subscription will be inactive immediately.

Acknowledgment

By purchasing a membership to Her Creative Studio you confirm that you have read and agree to the above terms and conditions. You also confirm that you are 18 years of age or older.

You confirm that you are a human. Accounts created by automated methods are not permitted.
